Bailey's Day Foundation Limited

Event Registration, Donations & Auction Terms & Conditions

These Terms and Conditions apply to registrations, ticket and table purchases, donations, auction participation and related fundraising activities conducted by Bailey’s Day Foundation Limited in connection with its 2027 events and campaigns.

By completing a registration, purchasing a ticket or table, making a donation, participating in an auction or otherwise completing a transaction with Bailey’s Day Foundation, you agree to these Terms and Conditions.

1. Bailey’s Day Foundation

Bailey’s Day Foundation Limited is a registered Australian charity and endorsed Deductible Gift Recipient.

The Foundation raises funds to support its charitable purposes, including the training and development of doctors working in paediatric oncology.

2. Event Registrations, Tickets and Tables

All event prices are quoted in Australian Dollars (AUD) and include GST where applicable.

A registration, ticket or table booking is confirmed once payment has been successfully processed and confirmation has been issued by Bailey’s Day Foundation or its authorised registration provider.

Unless expressly stated otherwise, payments for event registrations, tickets and tables are not tax deductible, as the purchaser receives a material benefit in return.

Any booking, payment-processing or third-party platform charges that may apply will be disclosed at or before the point of payment.

3. Attendee Names and Transfers

Registrations, tickets and table places may be transferred to another attendee.

Bailey’s Day Foundation does not impose a formal deadline for attendee-name changes and will endeavour to accommodate changes up to and including the day of the event.

Where possible, changes should be provided in advance to assist with event administration, catering, name badges and guest communications.

Requests may be directed to Bailey’s Day Foundation at info@baileysday.com.au or to the Foundation’s nominated event contacts.

4. Refunds

Event registrations, tickets and table purchases are non-refundable for change of mind, inability to attend or changes in personal circumstances, except where a refund or other remedy is required by Australian law.

A registration may instead be transferred to another attendee in accordance with clause 3.

If Bailey’s Day Foundation cancels an event, purchasers will be offered the remedies required under applicable law.

Where appropriate, a purchaser may also be offered the opportunity to convert an amount otherwise refundable into a donation to Bailey’s Day Foundation.

5. Postponement or Changes to an Event

Bailey’s Day Foundation reserves the right to make reasonable changes to an event, including changes to:

  • programs and running times;
  • entertainment, performers or speakers;
  • activities;
  • venue arrangements;
  • seating arrangements;
  • catering;
  • event format; or
  • other operational requirements.

If an event is postponed or rescheduled, registrations will ordinarily be transferred to the replacement date.

Nothing in these Terms limits any rights that a purchaser may have under Australian Consumer Law where an event is cancelled or significantly changed.

6. Event Attendance and Conduct

Attendees must comply with the reasonable directions of Bailey’s Day Foundation, event staff, security personnel and the relevant venues.

Bailey’s Day Foundation reserves the right to refuse admission or require a person to leave where their behaviour is:

  • unsafe;
  • disruptive;
  • unlawful;
  • offensive;
  • threatening; or
  • materially affecting the safety or enjoyment of other attendees.

No refund will be provided where a person is refused entry or removed for these reasons, except where otherwise required by law.

7. Donations

A genuine donation is a voluntary gift made to Bailey’s Day Foundation for which the donor does not receive a material benefit in return.

Eligible donations to Bailey’s Day Foundation may be tax deductible under Australian taxation law.

A donation receipt will be issued where appropriate.

Donations are generally non-refundable. Bailey’s Day Foundation may, however, consider refund requests arising from:

  • duplicate payments;
  • genuine payment errors;
  • unauthorised transactions; or
  • other exceptional circumstances.

A payment for an event registration, ticket, table, raffle ticket, auction purchase, merchandise or another material benefit is not treated as a donation merely because the proceeds support Bailey’s Day Foundation.

Donors should obtain their own taxation advice regarding their individual circumstances.

8. Third-Party Payment and Fundraising Platforms.

Bailey’s Day Foundation may use third-party providers to process:

  • registrations;
  • donations;
  • auction bids;
  • auction payments;
  • raffle purchases; and
  • other fundraising transactions.

Any optional contribution, gratuity or payment made directly to a third-party fundraising or payment platform is separate from the amount received by Bailey’s Day Foundation and may be subject to the third party’s own terms and conditions.

9. Silent Auction

Bailey’s Day Foundation may conduct a Silent Auction through an authorised online auction platform, including Givergy or another nominated provider.

By placing a bid, a bidder confirms that:

  • the bid is genuine;
  • they are authorised to make the bid;
  • they agree to pay the amount bid if successful; and
  • they accept any specific conditions attached to the relevant auction item.
  • The highest accepted bid at the close of the auction will generally be the successful bid.

Bailey’s Day Foundation reserves the right to resolve any dispute concerning bidding, auction closure or the successful bidder, acting reasonably and in good faith.

10. Main Auction

Bailey’s Day Foundation may conduct a live Main Auction during an event.

A bid acknowledged by the auctioneer or authorised event representative constitutes a genuine offer to purchase the auction item.

The highest accepted bid will be binding on the successful bidder.
Bailey’s Day Foundation reserves the right to:

  • set reserve prices;
  • withdraw an item prior to sale;
  • reject a bid where there is a genuine error or dispute; and
  • determine the successful bidder where there is uncertainty concerning competing bids.
11. Payment for Auction Purchases

Successful auction bids are binding and auction purchases are final and non-refundable for change of mind.

Payment must be made using the payment method specified by Bailey’s Day Foundation or its nominated auction platform.

Where a bidder has authorised a payment method through an auction platform, the Foundation or platform may process the successful purchase using that payment method.

Title to a physical auction item does not pass to the purchaser until full payment has been received.

12. Auction Items and Experiences

Many auction goods, services and experiences are generously donated by supporters of Bailey’s Day Foundation.

Descriptions, images, estimated values and other information are provided in good faith using information available to Bailey’s Day Foundation and/or provided by the donor.

Auction experiences may be subject to conditions including:

  • availability;
  • booking requirements;
  • blackout dates;
  • expiry dates;
  • capacity restrictions;
  • travel periods;
  • venue conditions; and
  • other requirements imposed by the donor or service provider.

Unless expressly stated otherwise, costs such as travel, transfers, insurance, meals, upgrades, taxes, registration costs and incidental expenses are the responsibility of the purchaser.

Successful bidders are responsible for booking or using an auction item within any stated validity period.

Nothing in these Terms excludes any consumer guarantee or other legal right that cannot lawfully be excluded.

13. Tax Treatment of Auction Purchases

An auction purchase is not automatically a tax-deductible donation because the purchaser receives goods, services or another material benefit in return.

Australian taxation law may allow a deduction in limited circumstances where a fundraising contribution exceeds the market value of the benefit received and the relevant statutory requirements are satisfied.

Accordingly, purchasers should not treat an auction payment as a tax-deductible donation unless Bailey’s Day Foundation expressly provides documentation confirming an eligible deductible component.

Purchasers should obtain their own taxation advice.

14. Donated Auction Items

A person or organisation donating an auction item confirms that:

  • they are entitled to donate the item, service or experience;
  • information supplied about the item is accurate to the best of their knowledge;
  • they have disclosed any material conditions or restrictions; and
  • the item can be provided to the successful purchaser on the terms represented.

Donors should advise Bailey’s Day Foundation of all:

  • expiry dates;
  • blackout periods;
  • booking requirements;
  • availability limitations;
  • exclusions; and
  • other conditions

before the item is promoted or offered for auction.

Bailey’s Day Foundation may determine whether a donated item is:

  • included in the Silent Auction;
  • included in the Main Auction;
  • combined with another donated item to create a package;
  • used in another fundraising activity; or
  • otherwise applied to support the Foundation’s charitable fundraising activities.
15. Recognition of Auction Donors and Supporters

Bailey’s Day Foundation greatly values the businesses, organisations and individuals who support its fundraising activities.

Where appropriate, Bailey’s Day Foundation may acknowledge an auction donor or supporter through:

  • the Bailey’s Day website;
  • event materials;
  • auction listings;
  • digital communications;
  • social media;
  • event signage; and
  • other Foundation communications.

By providing a business or organisation logo to Bailey’s Day Foundation in connection with a donation or other support, the supporter authorises the Foundation to use that logo for the purpose of acknowledging and promoting that support.

Bailey’s Day Foundation will use supporter logos respectfully and in a manner consistent with the supporter’s brand.

A donor or supporter may request that their contribution remain anonymous.
Unless otherwise expressly agreed, acknowledgement of an auction donation does not create sponsorship, exclusivity or endorsement rights.

16. Use of the Bailey’s Day Name and Brand by Supporters

Businesses, organisations and individuals who have provided genuine support to Bailey’s Day Foundation may identify themselves as a supporter of Bailey’s Day.

Bailey’s Day Foundation may provide approved logos, artwork and brand assets for this purpose.

Supporters must:

  • use the supplied artwork without material alteration;
  • accurately describe the nature of their support;
  • not imply a sponsorship, partnership or endorsement greater than that agreed with Bailey’s Day Foundation;
  • not use Bailey’s Day branding in connection with unlawful, misleading or inappropriate material; and
  • cease using Bailey’s Day branding if reasonably requested by the Foundation.

Bailey’s Day Foundation is happy to assist supporters with appropriate artwork and brand assets.

17. Collection and Delivery of Auction Items

Unless otherwise stated, successful bidders are responsible for arranging collection or delivery of physical auction items.

Where an auction experience or service is provided directly by the donor, Bailey’s Day Foundation will provide reasonable assistance in connecting the successful bidder with the donor or provider.

Bailey’s Day Foundation is not responsible for delays caused by circumstances outside its reasonable control but will endeavour to assist the parties in resolving any fulfilment issue.

18. Photography and Filming

Bailey’s Day events may be photographed, filmd or recorded for:

  • Foundation communications;
  • social media;
  • fundraising;
  • reporting;
    publicity;
  • archival purposes; and
  • promotion of future Bailey’s Day activities.

By attending an event, attendees acknowledge that incidental images or footage of them may be captured and used for these purposes.

Anyone with a particular concern about photography or filming should contact Bailey’s Day Foundation or speak with event staff.

19. Personal Information

Personal information collected in connection with registrations, donations, auctions and fundraising activities will be handled in accordance with Bailey’s Day Foundation’s Privacy Policy and applicable Australian privacy law.

Information may be provided to event, registration, auction, payment and other service providers where reasonably necessary to:

  • process transactions;
  • administer the event;
  • fulfil auction purchases;
  • communicate with attendees; or
  • conduct Foundation fundraising activities.

Operational communications concerning a booking, donation, auction transaction or event may be sent using the contact information provided.

20. Liability

To the maximum extent permitted by law, Bailey’s Day Foundation is not responsible for indirect or consequential loss arising from:

  • attendance at an event;
  • participation in an auction;
  • the use of an auction item;
  • participation in a donated experience; or
  • the acts or omissions of a third-party supplier.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy under Australian Consumer Law or other applicable legislation that cannot lawfully be excluded, restricted or modified.

21. Governing Law
